1. Scope and acceptance of the terms
These terms and conditions ("Terms") apply to the Gugguu Oy ("Gugguu") website www.gugguu.com ("Online Store") for the sale of products between Gugguu and the customer ("Customer").
The user of the Online Store ("User") must carefully read these Terms before using the Online Store. The Terms apply to all actions of the user in the Online Store.
Your contracting partner in all purchase transactions made in the Online Store is Gugguu Oy:

Gugguu has the right to update these Terms at any time. The updated Terms apply to orders placed after the effective date of the new Terms. By ordering, the customer accepts these Terms and agrees to comply with the Terms in full and simultaneously accepts the use of their personal data and cookies in accordance with Gugguu's privacy and cookie policies.
Please note that in addition to the rights defined in these Terms, you may have other rights arising from applicable legislation, which may vary by country.
In these Terms, the product ("Product") means a product available in the Online Store or ordered from the Online Store.
2. Using the Online Store and Registration
All persons aged 18 or over with a permanent delivery address and a valid email address, who order products to the Online Store's delivery area, may use the Online Store.
The Customer must provide accurate information about themselves when using the Online Store. The Customer is responsible for the accuracy of the information provided and is obliged to notify Gugguu without delay of any changes to the information. The Customer must be the legal owner of the bank/credit card used for the purchase transaction.
To order from the Online Store, the Customer must provide their name, address, phone number, payment details, and other information required for the purchase.
After placing an order, the Customer will receive a payment confirmation and an order confirmation by email, which includes the order number and the ordered products. The Customer will also receive a delivery confirmation by email when the order has been delivered. If all ordered products cannot be sent in the same shipment, customer service will contact the Customer primarily by email. The Customer will not incur any additional costs if the ordered products need to be sent in multiple batches.
The customer has the right to cancel their order free of charge before receiving the delivery confirmation by contacting customer service by email or phone at customer@gugguu.com/ +358 44 410 1736.
Returns of products after the delivery confirmation message are described in the section Right of Withdrawal.
The customer may choose to register as a customer of the Online Store to speed up transactions in the Online Store. Registration is free of charge. Registration is done with a valid email address and a password chosen by the customer. The customer is responsible for careful storage and confidentiality of the password and is responsible for all transactions made with their user credentials ("Customer Account") in the Online Store. The customer must immediately contact Gugguu if they notice or suspect that their credentials have been accessed by a third party or that their credentials are being misused. Gugguu has the right to freeze or close the customer's credentials if Gugguu detects misuse of the Customer Account.
Customer personal data is processed in accordance with the privacy policy. Personal and payment data are processed using an encrypted connection.
3. Content produced by the User for the Online Store
The User agrees not to produce or transmit to the Online Store any content that is illegal, contrary to good practice, otherwise inappropriate, infringes third-party rights, or unlawfully advertises products or services of a third party.
The User may only send, deliver, or publish content to the Online Store to which they have unrestricted rights, including the right to transmit the content to Gugguu and grant Gugguu the right to publish and use the User's content free of charge for the purpose for which it was collected.
Gugguu does not pre-screen content produced or transmitted by the User to the Online Store and is not responsible for it in any way. Gugguu reserves the right at any time, at its sole discretion and without prior notice, to remove content produced by the User that it considers to be in violation of these Terms or otherwise harmful/damaging to Gugguu or third parties, or to modify the content at its discretion, for example to correct typographical errors. Anyone can request the removal of content transmitted to the Online Store by contacting Gugguu Customer Service, and Gugguu will decide whether to comply with such a request.
4. Customer and Consumer Protection
In the customer relationship between a consumer customer and Gugguu, in addition to these Terms, the currently valid consumer protection legislation shall apply. For consumer protection purposes, it does not matter whether the consumer customer is registered or not.
In the customer relationship between a business customer and Gugguu, these Terms shall primarily apply and secondarily the currently valid Trade Act.
5. Product Information and Product Availability
Gugguu strives to ensure that the Online Store has up-to-date and correct information about the product and availability, but cannot guarantee the accuracy of the information, nor the availability or sufficiency of the products sold. Certain products are produced in limited quantities or may otherwise be temporarily sold out.
If after receiving the order it becomes apparent that the ordered product is temporarily or permanently out of stock despite the balance amount notified to the Customer by the system, Gugguu will notify the Customer without delay using the contact information provided by the Customer, primarily by email.
If the ordered product is not available at all, Gugguu commits to fully refund the Customer the price already paid for the ordered product, and the sale shall be considered canceled for that product. Gugguu's customer service will contact the Customer in such a situation, and the Customer has the option to keep the sale valid and accept a longer delivery time if possible by Gugguu or the delivery of a replacement product.
Gugguu reserves the right to update Product descriptions at any time at its discretion without prior notice.
Gugguu strives to ensure to the best of its ability that Products are presented in the Online Store in as accurate colors and truthfully as possible. Product images are sample images of the Products and are intended to be presented truthfully, but for example, the color of the lining material, snaps, or ribbons may differ from the Product sold to the Customer, but only if it does not significantly affect the appearance of the Product. We do everything we can to make product images correspond as well as possible to the actual products and their shades. However, we cannot guarantee that the colors of the products are accurate on all display settings.
6. Prices and taxes
The prices stated apply only to orders made in the online store. All product prices shown in the online store are the full retail prices of the products. Prices include VAT or other taxes applicable in the country of order. Prices do not include delivery fees. Order-specific delivery fees are shown at checkout when the customer selects the delivery method. Gugguu reserves the right to change prices and delivery fees, but any changes will only apply to orders placed after the changes take effect. Prices are shown in euros.
Gugguu reserves the right to cancel the customer's order if there is a clear and significant pricing error in the ordered product. This refers to a possible pricing error in the product on the online store where the product price deviates so significantly and clearly from the product's usual price level that an average consumer would be considered to understand it as an error. A clear pricing error would be, for example, if the product price is €0.00 or no price is shown at all, or if the product price is presented so low that it can generally be considered erroneous.
7. Delivery fees and methods
Gugguu delivers products as soon as possible after receiving the order. This takes approximately 2-3 business days, but during busy times no more than 10 business days. Busy times include various campaigns or new collection release dates. Some products may have a longer delivery time, and in such cases, the delivery time information is visible in the product details. If the order includes products with different delivery times, the order will be delivered all at once when the entire order is ready for delivery unless Gugguu states otherwise.
Gugguu delivers orders to Finland using Posti and Matkahuolto parcel services. For international deliveries, Gugguu uses EMS, DHL, or GLS parcel services depending on the customer's choice and the availability of the delivery method.
The customer can choose express delivery to a pickup point or home delivery for their order, in which case the order will be delivered by the next business day even during busy times. If express delivery is selected for a product with a longer delivery time, the order will be delivered within the delivery timeframe stated in the product information. The express delivery surcharge is €7, which is added to the normal delivery fee (pickup point €4.9/home delivery €7).
The Customer must note the storage times of packages at the pickup point. If the package is not picked up within the storage time, the package will be returned to Gugguu. For uncollected shipments, Gugguu charges the Customer €12/order, which covers delivery costs and other expenses incurred by Gugguu.
For orders to Finland, delivery costs to Matkahuolto or Posti pickup points are €4.9. If the total amount of ordered Products* exceeds €120, no delivery charges will be charged to the Customer if the customer chooses delivery to a pickup point. However, home delivery and express delivery always incur a charge of €7 each, even if the order total exceeds €120.
For deliveries outside Finland, delivery costs for DHL and EMS shipments are €15 within Europe and €19.5 outside Europe. Delivery costs for other delivery methods are €4.9 if the total amount of ordered Products* is below €120. Therefore, when the order value excluding delivery exceeds €120, no delivery charges are added to the order in normal delivery, except for DHL/EMS delivery.
*If the total amount of ordered Products exceeds €120 at the time of order and the Customer wants to return part of the Products so that the remaining order value is then below €120, delivery and return costs (€8.4) will be deducted from the amount refunded to the Customer.
8. Payment Methods
To provide a safe and easy shopping experience, Gugguu Online Store offers the following payment method options:
- Most common credit cards (Visa, Mastercard, Visa Electron)
- ApplePay, GooglePay, ShopPay
- Online Banks
- Invoice (Collector, Klarna)
- PayPal
- Gift Card
The payment service provider and payment service operators are Paytrail Oy, Shopify payments (Stripe), Klarna Bank AB, and PayPal in cooperation with Finnish banks and credit institutions. The payment method providers are third parties with whom Gugguu has cooperation agreements. The Customer enters all credit card or online banking payment details on the bank's or payment service provider's pages. Gugguu uses an encrypted SSL connection for data communications.
Credit Card Payments
Paying with a payment card in the online store is easy and secure. Gugguu does not have access to card information, nor are payment card details stored in the online store's information system. We accept Visa, MasterCard, and American Express payment cards in our online store. Please note your card's security limit for online purchases. You can check and adjust it in your online bank or bank branch. During the payment transaction, credit card information is always processed over a secure SSL connection.
Our online store uses international Verified by Visa and MasterCard SecureCode authentication services to verify the cardholder's identity. Card payments in the online store are provided either by Stripe (ApplePay, ShopPay, and GooglePay) or Paytrail Oy, which appears as the payee on the card statement and forwards the card payment made by the Customer to Gugguu.
On the bank statement and card invoice, the payee appears as Stripe or Paytrail Oy, which forwards the payment to the merchant. Stripe and Paytrail Oy have a payment institution license. In case of problems, please contact Gugguu customer service first.
Online banks
Customers can pay for their purchases with ApplePay, ShopPay, GooglePay, or online payment buttons. When a customer uses online banking as the payment method, they are temporarily redirected from the webshop to their own bank's online banking or Gugguu's partner (Paytrail Oy) online service and pay for the selected products directly from their account. The payment transaction appears on your bank statement, and the payee on the statement is Paytrail Oy, which forwards the payment.
Invoice/installment/account credit
Customers also have the option to pay for their purchases by invoice or account credit. Invoice and account credit are offered in cooperation with Paytrail Oy or Klarna Bank AB. When you choose invoice as the payment method, you will receive the products before paying for them. You can pay the invoice in full or split it into smaller parts by entering into an account credit agreement with our partner. PayPal
When you choose PayPal as the payment method, you will be redirected directly to PayPal at the end of the order process. If you are already a PayPal customer, you can log in with your credentials and confirm the payment. If you are a new PayPal customer, you can open a PayPal account and then confirm the payment.
Once your payment has been registered with us, your order will be processed by Gugguu. When the payment is completed, you will receive an order confirmation by email. Please note that processing errors can sometimes occur on PayPal's pages, which Gugguu cannot influence.
If you return products from an order paid via PayPal, we will refund the amount directly to your PayPal account. You can read more about returns in section 6. PayPal's terms of use can be found here.
Gift card
You can choose a gift card as the payment method at checkout, in which case your order will be paid entirely or partially from the gift card if the gift card value is not enough to cover the entire order, and you can pay the remaining order amount with your chosen payment method. The gift card is used by entering the gift card code into the designated field at checkout.
9. Right of withdrawal
Sales in the online store are distance sales as defined by consumer protection legislation. If the customer wants to exercise their right of withdrawal, they must make a return notification within 14 days of receiving the products. The return notification can be made by email to Gugguu customer service (customer@gugguu.com). The products to be returned must then be sent to Gugguu without delay, no later than 14 days. The return notification can also be made by filling out the return form, which the customer attaches to the shipment and sends to Gugguu within 14 days of receiving the products. For health and hygiene reasons, the right of withdrawal does not apply to swimwear or sheets if their seal has been opened.
When the customer cancels an order made in the online store, and unless otherwise agreed, Gugguu will refund the payment made using the payment method the customer used in the original purchase transaction. Gugguu will promptly refund the amount to be returned after processing the customer return, but no later than 14 days after receiving the products. The return does not cover additional costs arising from a delivery method other than the cheapest standard delivery offered by Gugguu. If only part of the order is returned, shipping costs will not be refunded. The customer is responsible for the depreciation of the product in use, and Gugguu has the right to deduct from the refund amount an amount corresponding to the depreciation of the product compared to its original value. If the product has become unsellable due to its use, the customer is responsible for the full value of the product and, if the customer wants the product to be sent to them again, for the shipping costs incurred.
The customer is obliged to handle the products carefully and pack the product so that it is not damaged during transport. The customer must include information about the products to be returned with the shipment. The return shipment must be left at a Posti or Matkahuolto service point, and the customer must ensure receipt of a return receipt. The shipment cannot be returned to a mailbox.
Sending the return is free of charge for the customer when the customer uses Gugguu's contract number for the return. The return costs of €3.5 will be deducted from the amount refunded to the customer.
Cancellation from Finland
Return via Posti:
The customer goes to the address: http://posti.fi/palautapaketti and enter the tracking code received from Gugguu on the page to get the Helposti code. The Helposti code obtained from Posti's website must be written on the shipment along with the sender's and recipient's name and address. The customer can leave the package either in a parcel locker or at a Posti service point.

Cancellation from outside Finland
The Customer contacts Gugguu's customer service (customer@gugguu.com).Contact our customer service (customer@gugguu.com), and we will arrange the return via DHL or GLS. Returns from outside the EU are at the customer's expense.
10. Defects in Delivery or Products
When the Customer has received the delivery, the Customer must promptly check that the delivered products are intact and otherwise free of defects. The Customer must also ensure that the delivery includes all the products ordered by the Customer.
Gugguu is responsible for defects in the delivery and delivered Products in accordance with Chapter 5 of the Consumer Protection Act. If the Products received by the Customer are defective or do not match the order, the Customer must immediately contact Gugguu's customer service (customer@gugguu.com).
If Gugguu has delivered a Product that does not match the order, Gugguu will primarily try to correct the error by delivering the correct Product to the Customer, and the Customer will return the incorrectly delivered Product to Gugguu free of charge.
If the shipment has been damaged during transport, Gugguu advises the Customer not to accept the shipment and to contact Gugguu's customer service about the matter.
If the Customer notices a defect in the Product according to the applicable consumer protection legislation, the Customer may, if desired, make a complaint to Gugguu regarding this.
If the complaint leads to the Product being sent to Gugguu, Gugguu is responsible for the shipping costs incurred from this shipment. If the product has been used, the customer must send the product washed.
When the Product subject to the complaint has been returned and the complaint is found to be justified, Gugguu will pay the customer a refund in accordance with the applicable consumer protection legislation. Gugguu aims to make the payment within thirty (30) days from the day Gugguu has received the Product subject to the complaint. If the Product returned due to the complaint is not defective according to the applicable consumer protection legislation, Gugguu may reject the complaint and the customer may be charged for the shipping costs incurred from returning the product.
A complaint about the Product must always be made directly to the place of purchase if the Product is defective.
These Terms do not limit the Customer's rights under applicable consumer protection legislation nor the statutory product liability of the entrepreneur, including the right to demand correction of defects or replacement of the product with a new one.
11. Text Message Marketing
By accepting Guggu's text message marketing at checkout, you agree to receive text messages and marketing offers even if your mobile number is registered on the call restriction list. Message frequency varies. Consent is not a condition of purchase.
If you wish to cancel your subscription to text marketing messages and notifications, reply STOP to any mobile message sent by us or use the unsubscribe link provided in our message.
You understand and agree that alternative opt-out methods, such as using alternative words or requests, are not considered reasonable ways to opt out. We do not charge for the service, but you are responsible for all text message charges and fees from your wireless service provider. Message and data rates may apply.

We reserve the right to change any phone number or shortcode we use for service access at any time. You will be notified of such changes. You agree that messages you send to a changed phone number or shortcode, including STOP requests, may not be received, and we are not responsible for compliance with requests made in such messages.
To the extent permitted by applicable law, you agree that we are not responsible for any failure, delay, or misdirected delivery of information sent through any service, errors in such information, and/or any actions you may or may not take.
Your right to privacy is important to us. You can review our privacy policy on how we collect and use your personal data.
Privacy Policy
We value your privacy and the information you consent to share in our text message marketing service. We use this information to send you text notifications (by subscription, including abandoned cart reminders), text marketing offers, and transactional texts, including review requests made by us.
Text message acceptance information and consent are not shared with any third parties, except communication partners, to enable and use our text messaging program.
Our website uses cookies to track products you have placed in the shopping cart, even when you have abandoned the checkout. This information is used to determine when shopping cart reminder messages are sent via text message.
12. Links to external sites
The Online Store may contain links to third-party websites or services. Even if a third party is affiliated with Gugguu, Gugguu cannot influence these linked sites or services, each of which has its own separate terms of use and/or privacy and data collection policies independent of Gugguu. These linked websites and services are provided only for support in use, and the Customer uses them at their own risk.
13. Validity
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be enforced to the greatest extent permitted by applicable law. This shall not affect the validity, legality, or enforceability of the other provisions in any way.
14. Force majeure
Unless otherwise provided by mandatory applicable legislation, Gugguu is not responsible for any delays or damages caused by circumstances beyond Gugguu's control. Such circumstances include, for example, general labor disputes, acts of war, fires, lightning, terrorist attacks, changes in official regulations, technical problems, faults in power/tele/computer connections or other communications, as well as faults and delays in services provided by subcontractors resulting from the aforementioned circumstances. If such a situation arises, Gugguu will notify the Customer. If the situation has lasted for more than two (2) months, both the Customer and Gugguu have the right to suspend the purchase transaction made in the Online Store with immediate effect.
14. Applicable law and dispute resolution
Finnish law applies to these terms and conditions.
All disputes related to these Terms or the Online Store and purchases made there are primarily resolved through negotiations between Gugguu and the Customer. If the Customer is not satisfied with the resolution of the dispute, the Customer has the right to contact the Competition and Consumer Authority's consumer advice and thereafter request the Consumer Disputes Board to propose a solution.
In case of disagreements, Gugguu strives to comply with the decisions of the Finnish National Consumer Disputes Board or corresponding authorities in other European countries.
The customer also has the right to bring the dispute to be resolved by the Oulu District Court or the first instance court of their own domicile.
